Abstract

في إطار الحركية التي تشهدها الجزائر من أجل تحقيق الإقلاع الاقتصادي من خلال تحديث وتفعيل المنظومة القانونية التي تحكم الاستثمار، سعى المشرع من خلال إصدار سلسة مترابطة من النصوص القانونية إلى إيجاد الآليات الكفيلة بزيادة فرص الاستثمار، ومحاولة تجاوز العقبات التي تعرقل ذلك سواء من حيث الإطار الموضوعاتي أو المؤسساتي. يعتبر القانون رقم 23-17 أحد أهم هذه النصوص القانونية، بالنظر لما كرسه من إمكانية توجيه واستغلال العقارات الاقتصادية التابعة للملكية الخاصة للدولة لاستقبال مشاريع استثمارية، وفق آليات وقواعد تحفيزية للمستثمرين من جهة وضوابط صارمة من جهة أخرى، ستتولى هذه الدراسة توضيحها. Within the framework of the movement witnessed by Algeria in order to achieve economic take-off though modernizing and activating the legal system that governs investment, the legislator sought, through issuing a coherent series of legal texts, to find mechanisms to increase investment opportunities and attempt to overcome the obstacles that hinder this, whether in terms of the thematic framework or Institutional. Law No.23-17 is considered one of the most important of these legal texts, given the authority it enshrines to direct and exploit economic real estate belonging to the state’s private ownership to receive investment projects, according to incentive mechanisms and rules for investors on the one hand, and strict controls on the other hand, which this study will clarify.
