رقابـة القاضي الإداري على دراسـة التأثيـر على البيئـة فـي الجزائر

Abstract

تكتسي "دراسة التأثير على البيئة" أهمية كبيرة في مجال حماية البيئة، إذ تعد تجسيدا لمبدأ الوقاية، وآلية لكبح الأضرار الايكولوجية التي تسببها النشاطات البشرية. وقد أخضعها المشرع لأنواع من الفحص والرقابة على عدة مستويات لضمان فعاليتها، من بينها رقابة أفراد المجتمع عبر آلية التحقيق العمومي. غير أن الواقع أثبت محدودية هذه الرقابة لأسباب عديدة، أهمها عدم مشاركة المختصين، وانحياز الإدارة للمشاريع التنموية على حساب البيئية، بسبب أهميتها الاقتصادية وأيضا بسبب ضغوط المنتفعين، كما أن هذا المجال ليس بمنأى عن مظاهر الفساد التي تعاني منها كل المجتمعات. ولهذا تبقى الرقابة القضائية، التي أثبتت نجاعتها في الدول الرائدة في هذا المجال، أهم ضمان لجدية وفعالية هذا الإجراء. The «Environmental Impact study» has a big importance in the environment protection field. It is considered as a modeling of the prevention principle and a mechanism to restrain ecological damages caused by human activities. The legislator subjected it to types of diagnosis and control at various levels to ensure its effectiveness, including the members of society’s supervision through the public investigation mechanism. However, reality has proved that supervision is limited for many reasons ; most notably non- participation of specialists and administration that favor development projects over environment , because their economic importance and beneficiaries’ pressure, also this field is not immune against corruption that affects all societies. That is why judicial control which proved its effectiveness in the leading countries in this field, remains the most important guarantee of the seriousness and effectiveness of this procedure.
