القاعدة الفقهية: "المصلحة العامة مقدمة على المصلحة الخاصة" ودورها في مكافحة الفساد

Abstract

هذه المداخلة بيان لمحتوى القاعدة الفقهية: ( المصلحة العامة مقدمة على المصلحة الخاصة )، وبيان حجيتها في ضوء الأدلة الشرعية، من الكتاب والسنة والاجماع والمعقول، واستجلاء دورها في محاربة الفساد بشكل عام سواء على الصعيد الاقتصادي، أو الاجتماعي، أو السياسي، أو الإداري، وكان من نتائج هذا البحث أن هذه القاعدة هي الخط الفاصل بين الصلاح والفساد حيث أن إهمال تطبيق القاعدة وعدم الوعي بأهميتها كان سببا في كثير من الأزمات التي تجتاح العالم الإسلامي على جميع الأصعدة، ولاشك أن هذه القاعدة بمضمونها المقاصدي وببعدها المآلي تكفل للأمة تصورا صحيحا يضمن استقرارها وتطورها. This research is a statement of the content of the jurisprudential rule: (the public interest is prioritized over the private interest) and its legitimacy in the light of the Share’a evidences; the Qur'aan, Sunnah, consensus and reasonable. In addition to the clarification of its role in combating corruption in general, whether was it economically, socially, politically or administratively. One of the significant results of this research is that this rule is the dividing line between righteousness and corruption. The neglect of the application of the rule and the lack of awareness of its importance have been the cause of many crises in the Islamic world at all levels. There is no doubt that this rule with its objectives and dimensions guarantee a correct vision to the nation in order to insure its stability and development.
